Customer Agreement

Customer Agreement, Scope of Works & Disclaimer — sealing bathrooms, tile roofs and concrete surfaces. Please complete your details, read the agreement below, and accept.

Surface Seal Townsville provides non-invasive remediation and sealing services designed to reduce water ingress through tiled and grouted surfaces using proprietary epoxy sealing systems. The service may include:

• Shower remediation (10 year product warranty 12 month labour warranty)
• Balcony sealing (10 year product warranty 12 month labour warranty)
• Wet area sealing eg laundry kitchen (10 year product warranty 12 month labour warranty)
• External Surface sealing applications (5 year product 12 month labour warranty)
• Grout and tile sealing (12 month warranty)
• Associated preparation and application works

Surface Seal Townsville does not remove tiles, replace waterproof membranes, undertake plumbing repairs, perform structural building repairs, or rebuild wet areas unless specifically stated in writing.

Surface Seal Townsville's standard application turnaround is 24–72 hours from commencement of works, depending on the specific job requirements and the size of the bathroom or wet area being treated. This timeframe is subject to site conditions, surface area, and curing requirements, and is an estimate only and may vary.

The Customer acknowledges that:

• Surface Seal Townsville has visually inspected the accessible areas only.
• Surface Seal Townsville cannot inspect hidden building elements without destructive investigation.
• Existing waterproof membranes, framing, substrates, plumbing systems, drainage systems and concealed building components are not visible and cannot be fully assessed.
• Surface Seal Townsville has not represented that the service replaces a compliant waterproof membrane installation.
• The Customer understands that the service is a remediation and sealing treatment designed to reduce water ingress through tiled and grouted surfaces.
• The Customer agrees to ensure the areas to be remediated will be dry at least 24 hours prior to the work commencing.

Surface Seal Townsville shall not be responsible for leaks, defects or failures caused by:

• Failed or deteriorated waterproof membranes.
• Plumbing defects.
• Burst pipes.
• Cracked pipes.
• Drainage defects.
• Structural movement.
• Building settlement.
• Foundation movement.
• Cracked substrates.
• Existing hidden water damage.
• Rot, mould or deterioration within concealed areas.
• Defects not visible at the time of inspection.
• Previous building work undertaken by others.
• Movement of tiles, grout or substrates occurring after treatment.
• Damage caused by third parties.
• Mould and Discolouration: This warranty does not cover mould growth or discolouration of grout, epoxy, or silicone sealants. It is the client's responsibility to maintain the resealed areas.
• Improper Use or Maintenance: Damage resulting from neglect, misuse, or failure to follow care instructions provided by Surface Seal Townsville.
• External Factors: Damage caused by structural movement, cracking, or third-party modifications to the resealed surface.

The Customer acknowledges that the treatment process cannot identify all hidden defects within the building structure. Should hidden defects exist behind walls, under floors, within cavities or beneath tiled surfaces, further building repairs may be required which are outside the scope of Surface Seal Townsville's services.

Any warranty provided by Surface Seal Townsville applies solely to the performance of the installed sealing system in accordance with the written warranty document provided. The warranty does not cover:

• Plumbing failures.
• Structural movement.
• Building defects.
• Membrane failures.
• Damage caused by others.
• Acts of nature.
• Flooding.
• Storm events.
• Abuse, neglect or improper maintenance.

The warranty is limited to the rectification, repair or replacement of the Surface Seal treatment at Surface Seal Townsville's discretion.

To the maximum extent permitted by law:

• Surface Seal Townsville's liability shall be limited to the value of the services supplied.
• Surface Seal Townsville shall not be liable for indirect, consequential or economic loss.
• Surface Seal Townsville shall not be liable for damage arising from pre-existing defects, hidden defects or conditions beyond its reasonable control.

The Customer warrants that:

• All information supplied is accurate.
• They have disclosed any known leaks or defects.
• They are authorised to engage Surface Seal Townsville.
• Safe access will be provided for all works.
